Terms of Service
Effective July 31, 2026
Foundinity is operated by Foundinity Private Limited ("Foundinity", "we", "us"). These Terms govern your use of the Foundinity website and app (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Who can use Foundinity
You must be 18 or older and able to form a binding contract. One account per person; your information must be accurate and kept up to date. You're responsible for complying with the laws that apply to you where you live - Foundinity is operated from India and offered globally, but we don't represent that it's appropriate or available everywhere.
2. Your account
You sign in through our authentication provider, optionally with Google. You're responsible for activity under your account and for keeping your login secure. Tell us promptly of any unauthorized use. We may refuse, suspend, or reclaim accounts (for example, for impersonation or a name that isn't yours).
3. What Foundinity does - and doesn't promise
Foundinity helps founders discover, connect, and chat with potential co-founders. We do not guarantee that you'll find a co-founder, receive matches, likes, or replies, or achieve any business outcome. Any suggestions or rankings we show are automated and are not advice or endorsements. Features and how the Service works may change, and access to particular features may depend on your plan.
4. How the product works, and its limits
To keep interactions high-signal, the Service applies usage limits and rules - such as limits on how many people you can connect with, how many conversations you can keep active, and how much you can exchange before scheduling a call, and the automatic recycling of connections that don't lead to a call within a set time. The specifics are shown in the app and may change. Attempting to bypass these limits or controls is a breach of these Terms (see Acceptable use).
5. Paid plans, cancellation and refunds
Foundinity may offer one or more paid plans that unlock additional features or higher usage limits. Current prices, the billing period, and what's included are shown in the app at the point of purchase.
Billing and renewal. Paid plans renew automatically each billing period until you cancel. Fees are charged through our payment processor. We may change prices or what a plan includes on a going-forward basis; changes are notified before they apply to your renewal, and you can cancel before renewing if you don't wish to continue. Taxes may apply.
Cancellation. You can cancel at any time from Settings in the app. Cancelling stops all future renewals but does not end your current billing period - your plan stays active until the end of the period you have already paid for, after which your account reverts to the Free plan. Your account, profile, matches and conversations are not deleted when a paid plan ends.
Refunds. Unless the law gives you the rights below, purchases are non-refundable and non-exchangeable. We don't offer partial or pro-rated refunds for unused time, and renewal charges are not refundable - you can cancel any time from Settings before your renewal date to avoid being charged.
Where required by law, you have these refund rights based on where you live:
- EU, EEA, Switzerland and the UK: you can withdraw and receive a full refund within 14 days of a one-off purchase or your first subscription payment. In the UK, each auto-renewal of an annual subscription starts a new 14-day window. This right ends early if you begin using the paid features after consenting to immediate access.
- Türkiye and Israel: a full refund within 14 days of purchase.
- South Korea, Brazil, China and Canada: a full refund within 7 days of delivery.
- Singapore: a full refund within 5 days of delivery or first access.
Outside these rights, we or our payment provider may issue a refund at our sole discretion for requests made within 14 days of the charge - typically only where a technical problem on our side prevented you from using what you paid for and we couldn't resolve it, or where a billing error occurred (such as a duplicate charge or a charge after a confirmed cancellation). Change of mind, dissatisfaction with matches or outcomes, or time already used don't qualify. A discretionary refund is voluntary and doesn't oblige us to grant one in the future.
To request a refund, email uddipta@foundinity.com. Approved refunds are returned to the original payment method within 14 days of approval. Refunds will not be issued where there is evidence of fraud, refund abuse, or other manipulative behaviour.
We may also issue promo codes granting paid features for a limited time; these are non-transferable, have no cash value, and may expire or be revoked if misused.
6. Your content
You own the content you submit - your profile information, messages, and feedback ("Your Content"). You grant Foundinity a worldwide, non-exclusive, royalty-free license to host, store, and display Your Content for the purpose of operating the Service, which includes showing your profile and messages to other users you interact with. You represent that Your Content is yours to share and doesn't violate any law or third-party right. We may remove content that breaches these Terms, but we're not obligated to monitor content.
7. Acceptable use
You agree not to:
- harass, threaten, defame, or discriminate against other users, or send spam or unsolicited promotions;
- post false, misleading, unlawful, obscene, or infringing content, or impersonate anyone;
- use the Service to recruit for anything unlawful, or for any purpose other than genuinely seeking a co-founder;
- scrape, harvest, or collect other users' data, or copy the matching output, whether manually or with bots or automation;
- attempt to circumvent plan limits, paywalls, or access controls, or access data you're not authorized to see;
- reverse-engineer, disrupt, overload, or probe the Service or its security;
- upload malware or infringe our or others' intellectual property.
8. Other users, and your safety
Foundinity is an introduction platform. We do not verify users' identities, backgrounds, credentials, or claims, and we do not run background checks. You are solely responsible for your interactions with other users and for any decision to communicate, meet, or enter into any business relationship or agreement with them. Do your own due diligence, and take normal safety precautions when meeting anyone in person or online. Foundinity is not a party to, and is not responsible for, any agreement, venture, dispute, or loss between users.
9. Third-party services
The Service relies on and may integrate third-party services (for example, to schedule calls, sign you in, or send email). Your use of those features may also be subject to the third party's own terms. We're not responsible for third-party services, and their availability isn't guaranteed. How we handle data through our providers is described in our Privacy Policy.
10. Our intellectual property
The Service - including its software, design, brand, and content we provide - belongs to Foundinity and its licensors. We grant you a limited, personal, non-transferable, revocable license to use the Service under these Terms. You get no other rights.
11. Feedback
If you send us feedback, suggestions, or ideas, we may use them without restriction or obligation to you.
12. Suspension and termination
You can stop using Foundinity anytime and delete your account from Settings. Deleting your account permanently removes your profile, matches, messages, meetings, and related data (and disconnects Google Calendar). We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or if we stop offering the Service. Sections that by their nature should survive termination - the content license, its limits, disclaimers, liability, indemnity, and governing law - survive.
13. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or that matches or results will meet your expectations.
14. Limitation of liability
To the maximum extent permitted by law, Foundinity and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from your use of the Service or your dealings with other users. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.
15. Indemnification
You agree to indemnify and hold Foundinity harmless from claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your dealings with other users, or your breach of these Terms.
16. Changes
We may update the Service and these Terms. If we make material changes, we'll update the "Effective" date and, where appropriate, give notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of India, and the courts of Guwahati, Assam have exclusive jurisdiction - except where the mandatory consumer-protection or data-protection laws of your own country (for example in the EU, UK, or California) give you rights that can't be waived, which continue to apply to you.
